Terms of Service

These Terms of Service ("Terms") govern your access to and use of the websites (including grankr.com), applications, and related services offered by GRankr (grankr.com) ("GRankr," "we," "us," or "our"). By creating an account, accepting an invitation, or otherwise using our offerings, you agree to these Terms. If you do not agree, do not use the Service.

Our Privacy Policy explains how we handle personal information and is incorporated into these Terms by reference.

GRankr (grankr.com) provides generative engine analytics tools that help teams monitor how AI engines mention and rank brands over time. Track your brand visibility across ChatGPT, Perplexity, Gemini, Claude, and other AI engines.

The Service may include dashboards, project and organization workspaces, configurable tracking prompts, visibility metrics, and related features. Specific capabilities may vary by account, plan, or release.

Brand visibility tracking is performed by sending your configured prompts and related inputs to third-party AI models through each provider's application programming interface (API). The Service does not access or replicate the consumer-facing applications, search interfaces, or user experiences offered by those providers. Metrics and outputs shown in the Service reflect API responses and may differ materially from what an end user would see when using the provider's own products or websites.

The Service is currently offered in an Alpha (pre-release) phase. During this phase, we are not offering a generally available commercial product. Instead, we invite selected users to participate in free user testing to help us evaluate, improve, and validate the Service before wider release.

By participating in Alpha testing or a free trial, you acknowledge that:

• Free trial. Access offered as a "free trial" or free tier is provided for a limited period only. The length of that period, and any usage caps, are determined by us and may differ by account. We may end or shorten your free trial at any time, for any reason, without prior notice, including when we introduce paid plans, close the Alpha program, or discontinue the Service;
• Access is provided on a trial and evaluation basis, may be limited or revoked at any time (with or without notice), and does not constitute a commitment to provide ongoing or production-grade service;
• Features, limits, data retention, and availability may change frequently or be discontinued without prior notice;
• The Service may contain errors, incomplete functionality, or interruptions, and we do not guarantee accuracy of analytics or AI-generated outputs;
• You should not rely on the Service for business-critical or compliance decisions without independent verification; and
• We may suspend or terminate Alpha or free-trial access at any time, with or without notice, for maintenance, abuse prevention, capacity limits, or any other reason.

Alpha participation is currently free of charge. We may request feedback; any feedback you provide may be used to improve the Service without obligation to you.

Paid subscription plans and commercial pricing are not yet available. References to plans, tiers, or waitlists on our website at grankr.com or in the product describe intended future offerings and do not create a binding offer. When paid plans are introduced, they will be subject to separate pricing, ordering, and billing terms presented at checkout or in an order form. Continued use of paid features will require acceptance of those terms.

Joining a waitlist or requesting a plan upgrade during Alpha does not guarantee future access, pricing, or feature availability.

You must be at least 18 years old (or the age of majority in your jurisdiction) and able to enter a binding contract to use the Service. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

You are responsible for your account credentials, activity under your account, and ensuring that information you provide is accurate and kept up to date. Notify us promptly at contact@grankr.com if you suspect unauthorized access.

The Service supports multi-user organizations. Organization owners and admins may invite members, assign roles, and configure workspace settings. You are responsible for how your organization uses the Service and for ensuring that invited users comply with these Terms.

You agree not to:

• Use the Service in violation of applicable law or third-party rights;
• Attempt to gain unauthorized access to the Service, other accounts, or our systems;
• Interfere with or disrupt the Service, including by automated scraping or overload;
• Upload or track content you do not have rights to use, or that is unlawful, harmful, or misleading;
• Reverse engineer or circumvent security or usage limits except where permitted by law;
• Use the Service to develop a competing product using non-public aspects of the Service; or
• Misrepresent your identity or affiliation.

We may investigate violations and suspend or terminate access without liability.

You retain ownership of content you submit to the Service, including brand names, website URLs, prompts, and organization data ("Customer Content"). You grant us a non-exclusive, worldwide license to host, process, transmit, and display Customer Content solely as necessary to operate, improve, and secure the Service during the Alpha program and any later commercial period, in accordance with our Privacy Policy.

You are solely responsible for Customer Content and for obtaining any permissions required to use it with the Service. Outputs generated through AI providers reflect third-party models and may be incomplete or inaccurate; you are responsible for how you use them.

The Service relies on third-party infrastructure and AI providers. Tracking and analytics are delivered through provider APIs as described in About the Service above; we do not control how those providers operate their consumer products. Your use of those providers' outputs may be subject to their terms. We are not responsible for third-party services outside our control.

We and our licensors own the Service, including software, design, branding, and documentation, except for Customer Content. These Terms do not grant you any rights to our trademarks or brand assets except as needed to use the Service as intended.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT RESULTS WILL BE ACCURATE OR RELIABLE, ESPECIALLY DURING ALPHA.

TO THE FULLEST EXTENT PERMITTED BY LAW, NEITHER GRANKR (grankr.com) NOR ITS AFFILIATES, OFFICERS, EMPLOYEES, OR SUPPLIERS WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICE OR THESE TERMS.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (USD $100). BECAUSE ALPHA ACCESS IS CURRENTLY FREE, THIS LIMIT WILL OFTEN BE USD $100.

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the maximum extent permitted by law.

You will defend, indemnify, and hold harmless GRankr (grankr.com) and its affiliates from claims, damages, and expenses (including reasonable legal fees) arising from your Customer Content, your use of the Service, or your violation of these Terms, except to the extent caused by our gross negligence or willful misconduct.

You may stop using the Service at any time. We may suspend or terminate your access, including during Alpha, with or without notice. Upon termination, your right to use the Service ends. Provisions that by their nature should survive (including disclaimers, limitations of liability, and indemnification) will survive.

We may update these Terms from time to time. We will post the revised version on this page and update the effective date. Material changes may be communicated by email or in-product notice where appropriate. Continued use after changes become effective constitutes acceptance of the updated Terms.

These Terms are the entire agreement between you and GRankr (grankr.com) regarding the Service and supersede prior understandings on the subject. If any provision is unenforceable, the remainder remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.

These Terms are governed by the laws applicable in our principal place of business, without regard to conflict-of-law rules, except where mandatory consumer protections in your country require otherwise.
